This contract governs the sale of new goods via the provider’s online shop. For details of the respective offer, please refer to the product description in the product page.

The contract is concluded exclusively in electronic commerce via the shop system. The offers presented represent a non-binding invitation to submit an offer through the customer’s order, which the provider can then accept. The ordering process for concluding the contract comprises the following steps in the shop system:

• Choice of a product in various specifications such as size, colour and number of items.
• Adding the offer to the shopping cart
• Pressing the “order” button
• Entering the billing and delivery address
• Selecting the payment method
• Review and processing of the order and all entries
• Pressing the “order now” button
• Confirmation email that the order has been received. The contract is concluded when the order confirmation is sent.

The contract has a term of 3 months, subject to termination.

The delivered goods remain the property of the supplier until full payment has been made.

All prices are final prices and include statutory value added tax. In addition to the final prices, further costs may be incurred depending on the shipping method, which will be displayed before the order is shipped. If there is a right of withdrawal and this is exercised, the customer shall bear the costs of the return shipment.

The customer has the following payment options: payment service provider (Apple Pay, Klarna), credit card. Other payment methods are not offered and will be rejected.
When using an escrow service/payment service provider, this enables the provider and customer to process the payment between themselves. The escrow service/payment service provider forwards the customer’s payment to the provider. Further information is available on the website of the respective escrow service/payment service provider. When paying by credit card, the customer must be the card holder. The credit card will be charged right at the checkout.

The goods will be dispatched immediately after receipt of the order. Dispatch takes place on average after 1-2 days. The entrepreneur undertakes to deliver no later than 4 days after receipt of the order, unless it concerns custom-made products and individual items. The standard delivery time is 2-4 days within Europe. For destinations outside the EU please read our delivery terms. The provider will ship the order from its own warehouse as soon as the entire order is in stock. The customer will be informed immediately of any delays. If the supplier is unable to deliver due to circumstances beyond its control, in particular force majeure or non-delivery by its own suppliers, even though a corresponding covering transaction was carried out in good time, the supplier has the right to withdraw from the contract with the customer. The customer will be informed of this immediately and any payments received will be refunded.

Consumers are entitled to statutory liability for defects in accordance with the relevant provisions of the German Civil Code (BGB) for the services offered. In the event of any deviation from this, the warranty shall be governed by the provisions set out in the General Terms and Conditions (GTC).

The customer can correct errors made during the ordering process. To do so, they can proceed as follows: Cancel the order or return to the entry to be corrected.

Cancellation policy

Right of cancellation

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day,

• In the case of a sales contract: on the day on which you or a third party designated by you, who is not the carrier, took possession of the last goods.
• In the case of a contract for multiple goods that the consumer has ordered as part of a single order and that are delivered separately: on the day on which you or a third party designated by you, who is not the carrier, took possession of the last goods.
• In the case of a contract for the delivery of goods in multiple partial shipments or pieces: when you or a third party designated by you, who is not the carrier, has taken possession of the last partial shipment or the last piece.
• Im Falle eines Vertrages zur regelmäßigen Lieferung von Waren über einen festgelegten Zeitraum hinweg: an dem Sie oder ein von Ihnen benannter Dritter, der nicht Beförderer ist, die erste Ware in Besitz genommen haben bzw. hat.

If there are several alternatives, the latest date shall apply.

To exercise your right of withdrawal, you must inform us (KB collection e.U., Klaus Bösch, Bahnhofstrasse 4, 6890 Lustenau, AUSTRIA, +43-5577-86454, sandman@sandpicture.com) by means of a clear statement (e.g. a letter sent by post mail or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but this is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the inexpensive standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods without delay and in any case no later than fourteen days from the date on which you notify us of your withdrawal from this contract to KB collection e.U., Klaus Bösch, Bahnhofstrasse 4, 6890 Lustenau, AUSTRIA +43-5577-86454, sandman@sandpicture.com . The deadline is met if you send the goods before the expiry of the fourteen-day period.

You shall bear the direct costs of returning the goods.

You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties and functionality.

Claims for damages by the customer are excluded, unless otherwise specified in the following reasons. This also applies to the provider’s representatives and vicarious agents if the customer asserts claims for damages against them. This does not apply to claims for damages by the customer due to injury to life, limb, health or essential contractual obligations that must be fulfilled in order to achieve the contractual objective. Likewise, this does not apply to claims for damages due to grossly negligent or intentional breach of duty by the provider or its legal representative or vicarious agent.

Claims or rights of the customer against the provider may not be assigned or pledged without the provider’s consent, unless the customer has demonstrated a legitimate interest in the assignment or pledge.

The contract is written in English. The further implementation of the contractual relationship shall be in English. Austrian law shall apply exclusively. For consumers, this shall only apply insofar as it does not restrict any statutory provisions of the country in which the customer has his place of residence or habitual abode. The place of jurisdiction for disputes with customers who are not consumers, legal entities under public law or special funds under public law shall be the registered office of the provider.

In connection with the initiation, conclusion, processing and reversal of a purchase contract based on these General Terms and Conditions, data is collected, stored and processed by the provider. This is done within the framework of the statutory provisions. The provider does not pass on any personal data of the customer to third parties, unless it is legally obliged to do so or the customer has expressly consented to this in advance. If a third party is used for services in connection with the processing of data, the provisions of the Federal Data Protection Act are complied with. The data provided by the customer when placing an order will be processed exclusively for the purpose of establishing contact within the framework of contract processing and only for the purpose for which the customer has provided the data. The data will only be passed on to the shipping company responsible for delivering the goods in accordance with the order to the extent necessary. Payment data will be passed on to the credit institution responsible for processing the payment. Insofar as the provider is subject to retention periods under commercial or tax law, some data may be stored for up to ten years. During visits to the provider’s online shop, anonymised data that does not allow any conclusions to be drawn about personal data and is not intended to do so, in particular IP address, date, time, browser type, operating system and pages visited, is logged. At the customer’s request, personal data will be deleted, corrected or blocked within the framework of the statutory provisions. Information about all personal data relating to the customer is available free of charge. The invalidity of any provision of these General Terms and Conditions shall not affect the validity of the remaining provisions.
